CONVENTION Resolutions

Washington, DC August 2 - 4, 2012

Committee on Budget

RESOLUTION TO AMEND THE CONSTITUTION TO INCREASE INITIATION FEES- APPROVED

WHEREAS, the Council of Phi Delta Phi was charged by the delegates of the 60th Convention to explore the financial feasibility of increasing student initiation fees;

NOW THEREFORE BE IT RESOLVED THAT:

Article XII, Section 1 of the Constitution is hereby amended to delete, "U.S. $75.00 effective January 1, 2004” after, "[e]ach initiate of the Fraternity shall pay an initiation fee of…” and replace it with "U.S. $100.00 effective January 1, 2013…”

RESOLUTION TO HONOR HENRY "HANK” ADLER BERLINER- ADOPTED

WHEREAS, Hank Berliner was an esteemed member of John Marshall Inn Class of 1962 at George Washington School of Law, and;

WHEREAS, Mr. Berliner served as a Justice on the Court of Appeals, and;

WHEREAS, Mr. Berliner served as Chief Justice, and;

WHEREAS, Mr. Berliner served on Council, and;

WHEREAS, Mr. Berliner served as President of Phi Delta Phi, and;

WHEREAS, Mr. Berliner was responsible for the prosperity of Phi Delta Phi from the 1960s through the 1980s, and;

BE IT THEREFORE RESOLVED THAT:

Phi Delta Phi honors Mr. Hank Berliner's accomplishments, character, and commitment to Phi Delta Phi in memoriam at its 60th General Convention in Washington, D.C. on August 4, 2012.

RESOLUTION TO HONOR LEONARD BRAITHWAITE- ADOPTED

WHEREAS, Leonard Braithwaite was an esteemed member of Osgoode Inn Class of 1955 at Osgoode Hall, and;

WHEREAS, Mr. Braithwaite overcame racial discrimination to become the first Phi Delta Phi member of African descent, and;

WHEREAS, Mr. Braithwaite was instrumental in creating and contributing to the Faces of Phi Delta Phi: Leaders, Lawyers and Legend;

BE IT THEREFORE RESOLVED THAT:

Phi Delta Phi honors Mr. Leonard Braithwaite's accomplishments, character, and commitment to Phi Delta Phi in memoriam at its 60th General Convention in Washington, D.C. on August 4, 2012

RESOLUTION TO HONOR JOHN WESLEY SHENK III- ADOPTED

WHEREAS, John Wesley Shenk III was an esteemed member of Miller Inn Class of 1939 at Stanford Law School, and;

WHEREAS, Mr. Shenk served as a Justice on the Court of Appeals, and;

WHEREAS, Mr. Shenk served as Chief Justice, and;

WHEREAS, Mr. Shenk served on the Council, and;

WHEREAS, Mr. Shenk served as President of Phi Delta Phi, and;

WHEREAS, Mr. Shenk served as President Emeritus of Phi Delta Phi, and;

WHEREAS, Mr. Shenk made significant and continual contributions to the Phi Delta Phi Legal Institute, and;

WHEREAS, Mr. Shenk is the namesake of Shenk Inn at Southwestern Law School;

BE IT THEREFORE RESOLVED THAT:

Phi Delta Phi honors Mr. John Shenk's accomplishments, character, and commitment to Phi Delta Phi in memoriam at its 60th General Convention in Washington, D.C. on August 4, 2012.

RESOLUTION TO HONOR ROBERT TOPP- ADOPTED

WHEREAS, Robert Topp was an esteemed honorary member of Osgoode Inn on March 18, 2000, and;

WHEREAS, Mr. Topp was an Assistant Province President, serving with his son, Daniel Topp, currently Province President, and;

WHEREAS, Mr. Topp was a member of the International Barrister Society of Phi Delta Phi;

BE IT THEREFORE RESOLVED THAT:

Phi Delta Phi honors Mr. Robert Topp's accomplishments, character, and commitment to Phi Delta Phi in memoriam at its 60th General Convention in Washington, D.C. on August 4, 2012.

RESOLUTION TO AMEND THE CONSTITUTION TO CREATE A PRE-LAW SOCIETY- APPROVED

WHEREAS, the Council of Phi Delta Phi was charged by the delegates of the 59th Convention to explore the options for a pre-law society, and;

WHEREAS, the Council has made a report of their findings to the delegates to the 60th Convention, and;

WHEREAS, the Delegates of the 60th Convention have found the creation of a Pre-Law Society necessary to benefit the growth of Phi Delta Phi;

NOW THEREFORE BE IT RESOLVED THAT:

Article II, Section 1 of the Constitution is hereby amended to include:

Insert after "… hereafter chartered by the Council.”:

"This Society shall also charter, administer and manage a pre-law society with similar goals and objectives of Phi Delta Phi.”

Article VII of the Constitution is hereby amended to include:

"Section 5. The Council will be vested with the authority to control, direct finances, and promulgate the rules necessary for the creation and growth of the pre-law society.”

CONSTITUTIONAL AMENDMENT TO REPLACE THE WORD "FRATERNITY” WITH THE WORDS "HONOR SOCIETY” IN THE NAME OF THE ORGANIZATION IF THE RESOLUTION TO MAKE PHI DELTA PHI AN HONORS ORGANIZATION PASSES- APPROVED

WHEREAS, Phi Delta Phi has historically been referred to as a "Fraternity”

NOW THEREFORE BE IT RESOLVED THAT:

The name of the International Legal Fraternity of Phi Delta Phi is hereby changed to The International Legal Honor Society of Phi Delta Phi;

BE IT FURTHER RESOLVED THAT:

In all places in the Constitution, other than the Preamble, where the word "Fraternity” appears, it shall be replaced with the words "Honor Society”.

Further resolved that:

Amend Article I to read: "The name of this organization is The International Legal Honor Society of Phi Delta Phi. This organization may also be referred to by its historical name, The International Legal Fraternity of Phi Delta Phi."

RESOLUTION TO DIRECT THE COUNCIL TO INCREASE THE INITIATION FEE FOR STUDENTS IN MEXICO- UNDER CONSIDERATON

WHEREAS, Phi Delta Phi has historically been an honor society, and the Delegation from Mexico in the 60th Convention hopes to support the economic issues that have affected the Fraternity;

WHEREAS, it is our desire to increase the Initiation Fee from $45.00 to $75.00 (US Dollars);

NOW THEREFORE BE IT RESOLVED THAT:

We do not need an Amendment because the Constitution states one equal Initiation fee for every new member, so it's only a Resolution that we put forward for your consideration.


Committee on the Future Growth of Phi Delta Phi

RESOLUTION TO AMEND THE CONSTITUTION TO ABOLISH THE PROHIBITION OF PHI DELTA PHI MEMBERS BEING MEMBERS OF OTHER LEGAL FRATERNITIES- APPROVED

WHEREAS, Phi Delta Phi has historically prohibited membership of any member in another legal fraternity,

NOW THEREFORE BE IT RESOLVED THAT:

Art. III, Section 9 of the Constitution be abolished in total.


RESOLUTION TO AMEND THE CONSTITUTION TO MANDATE ALL INNS BE HONORS CHAPTERS TO FURTHER PHI DELTA PHI AS AN INTERNATIONAL HONORS SOCIETY- APPROVED

WHEREAS, Phi Delta Phi has historically been an honor society, and;

WHEREAS, academic requirements for membership were established by the Inns directly, and;

WHEREAS, the Delegates of the 60th Convention desire to return Phi Delta Phi to an Honor Society with certain requirements for all members in Phi Delta Phi;

NOW THEREFORE BE IT RESOLVED THAT:

Article III, Section 3 is hereby amended as follows:

The following shall be inserted after the words "in good scholastic standing” "as defined in Section 3(a),”

Article III, shall further be amended to include Section 3(a) which is to be inserted directly after Section 3. The verbiage for Section 3(a) is as follows:

"In good scholastic standing” shall be defined as not less than the top 1/3 of the class or other recognized, scholastic, professional ethics or service standard in which the candidate for membership has excelled, including, but not limited to, membership on Moot Court, published journals, or service in legal clinics or community service as approved by the Council.
